Preamble

Introduction

These Terms and Conditions constitute a legally binding contract between Assos Moto Rent And Go, operated by Kondi Marko, with registered place of business at Unnamed Road 0, Asos 280 84, Kefalonia, Greece (the "Company"), and any individual who rents, attempts to rent, or uses a vehicle provided by the Company (the "Renter"). By completing a rental agreement, making a reservation, accepting a vehicle, or accessing the Company's website, you unconditionally accept all terms in this document. This Agreement applies to all rentals of scooters and bicycles offered by the Company, whether booked online, by telephone, by email, or in person. These terms supersede all prior representations or verbal agreements. The Company reserves the right to amend these Terms at any time. Amendments take effect immediately upon publication on the website.

Section 1

Parties & Definitions

The Company

Assos Moto Rent And Go, operated by Kondi Marko, Unnamed Road 0, Asos 280 84, Kefalonia, Greece. Contact: +30 6986699311 / mrkkondi@gmail.com.

The Renter / Lessee

The individual named on the rental contract who accepts a vehicle from the Company and assumes full legal and financial responsibility for it during the rental period.

Additional Driver

Any person other than the primary Renter who is authorised in writing at the start of the rental to operate the rented vehicle. All additional drivers must meet the same eligibility requirements as the primary Renter.

Rental Period

The time from the moment the Renter takes possession of the vehicle at the Company's station to the moment the vehicle is returned and formally inspected by Company staff.

Vehicle / Unit

Any scooter or bicycle provided by the Company under the terms of a rental agreement, including all components, accessories, keys, locks, and provided safety equipment.

Commercial Value

The market replacement value of the vehicle as assessed by the Company at the time of loss or damage, taking into account the vehicle's age, condition, and current market pricing.

The Renter must present the original driving licence (not a photocopy) at the time of vehicle collection. An international driving permit is accepted where accompanied by the national licence from which it was issued. The Company reserves the right to refuse a rental to any individual who cannot produce a valid, in-force licence for the appropriate vehicle category.

Holding a Category B (car) licence alone does not automatically qualify a person to ride a scooter under Greek law. It is the Renter's sole responsibility to verify that their licence is valid for the specific engine category of the scooter rented.

By accepting a vehicle, the Renter confirms they are legally entitled to operate that vehicle class, their licence is not expired, suspended, or revoked, and they are medically and physically fit to ride safely.

At the time of collection, the Renter and a Company representative will jointly conduct a pre-rental inspection. Any pre-existing damage will be noted on the rental contract. Damage not recorded at collection will be presumed to have occurred during the rental period and the Renter will be held responsible. The Renter must not make any modifications to the vehicle and must not exceed the vehicle's maximum load capacity. The Company does not guarantee that any specific model will be available on the booking date. If the reserved vehicle is unavailable, the Company may provide an equivalent vehicle or offer a full refund.

Section 4

Booking & Reservation

Reservations may be made through the Company's website, by telephone, or in person at the Company's station during opening hours. A reservation is confirmed only upon receipt of confirmation from the Company. The Renter is responsible for providing accurate personal information at the time of booking. Providing false or inaccurate information constitutes a material breach of this Agreement and entitles the Company to refuse or immediately terminate the rental without refund. The Company may request a copy of the Renter's identification and driving licence prior to confirming a reservation.

Section 5

Rental Duration & Extensions

The minimum rental period for all vehicle categories is one (1) full day, equivalent to twenty-four (24) hours from the time of vehicle collection.

Important: Overtime Policy

Any delay in returning the vehicle that exceeds six (6) hours beyond the agreed return time will be automatically charged as an additional full rental day. No exceptions apply.

Extensions must be requested by telephone prior to the original return time and are subject to availability. Early returns do not entitle the Renter to any refund of unused rental days. The rental period begins the moment the Renter takes possession of the keys and ends the moment the vehicle is returned, inspected, and keys are handed back to Company staff during opening hours.

Pick-Up, Delivery & Return

Collections and returns must occur within opening hours. Outside of regular hours and on public holidays, collection and return may be arranged by prior appointment only. Additional charges may apply for out-of-hours services. At collection, the Renter must present: a valid driving licence (original), a valid form of identification, and a credit card for the security deposit. At return, the vehicle will be inspected jointly. A Renter who returns the vehicle without being present for inspection waives the right to dispute any damage findings.

Section 7

Security Deposit

A security deposit is required for all scooter rentals before the vehicle is released. The deposit is held as security against potential damage, loss, theft, outstanding fines, fuel charges, additional rental days, or any other sums owed.

Credit card pre-authorisation or cash hold.

Release Timing

Upon satisfactory return and inspection.

The deposit amount is communicated to the Renter in advance and may vary by vehicle category, rental duration, and season. The deposit will be released in full after the vehicle has been returned, inspected, and confirmed free from damage, and after all outstanding charges are confirmed as nil. The Company may retain the deposit in part or in full to cover any costs arising from this Agreement. Where costs exceed the deposit, the Renter remains liable for the full outstanding balance. Bicycles do not require a security deposit unless the Company determines otherwise.

Section 8

Payment Methods & Pricing

The rental fee is due and payable in full upon delivery of the vehicle. Accepted payment methods:

  • Cash (Euro)
  • Visa credit or debit card via POS terminal
  • Mastercard credit or debit card via POS terminal
  • Apple Pay via POS terminal
  • Bank transfer by prior arrangement only (confirmation of receipt required before vehicle release)

American Express cards are not accepted. All prices are in Euros and are inclusive of applicable Greek VAT. Bank transfer payments must be received and cleared before the vehicle will be released.

Section 9

Cancellations, No-Shows & Refunds

Strict No-Refund Policy

All bookings are non-refundable. No refunds will be issued under any circumstances whatsoever, including but not limited to: voluntary cancellations by the Renter, no-shows, changes to booking dates or vehicle category, early return of the vehicle, force majeure events including adverse weather, ferry cancellations, illness, or personal emergencies, or failure to meet eligibility requirements at the time of collection.

A no-show occurs when the Renter fails to collect the vehicle within two (2) hours of the agreed collection time without prior notice. The booking is then automatically cancelled and the full rental fee is forfeited. In the rare event that the Company cannot fulfil a confirmed booking due to circumstances within the Company's control, the Company will offer either an alternative vehicle of equal or greater value or a full refund. This represents the Company's sole liability in such circumstances.

Section 10

Insurance & Liability

All scooter rental prices include basic third-party liability insurance (simple liability insurance) as required under Greek law. This covers the Renter only in respect of liability to third parties for bodily injury or property damage caused by the vehicle in circumstances where the Renter is not at fault. The Renter remains fully liable for any damage or theft (whether partial or total) caused to the rented vehicle itself, up to the full commercial value of the vehicle.

Damage Reimbursement Procedure

In the event of damage to the vehicle, the Renter is required to pay the Company the full cost of repair or replacement directly and immediately, regardless of fault. If and when the insurance company compensates the Company, the amount paid by the Renter will be reimbursed. The Company provides no guarantee as to the timeline of insurance settlement.

Personal Accident Coverage

The insurance included does not cover the Renter's personal injuries in all circumstances. The Renter is covered for personal injury only if the accident was caused by another party and the Renter was not at fault. Renters are strongly advised to obtain independent personal travel insurance and personal accident coverage.

Bicycles

Bicycles are not covered by motor insurance. The Renter assumes full personal liability for any damage to the bicycle, injuries sustained, or damage caused to third parties during the bicycle rental period.

Section 11

Insurance Exclusions

The following circumstances and types of damage are explicitly excluded from any insurance coverage. In all cases below, the Renter bears sole and full financial liability.

  • Alcohol or drugs: Any accident, damage, or loss occurring when the driver is found to be under the influence of alcohol, narcotics, medication, or any substance that impairs judgment or motor function.
  • Driver at fault: Any accident where the Renter or authorised driver is determined by the relevant authorities to be responsible for the incident.
  • Unpaved roads: Any damage caused by driving on unpaved, off-road, dirt, gravel, or otherwise unsurfaced roads.
  • Undercarriage, tyres, and rims: Damage to the underside of the scooter, tyres, wheel rims, or any component that comes into contact with the road surface.
  • Unauthorised driver: Any accident caused by a person who was not declared as an authorised driver on the rental contract at the start of the rental.
  • Failure to report the accident: Any incident for which the Renter failed to inform the Company immediately and subsequently failed to file an official accident statement as required under Greek Legislation, regardless of fault.
  • Debit or credit card insurance: If the Renter holds travel or car hire excess coverage through their personal card, this does not affect the Renter's obligations to the Company. The Renter remains obligated to pay the Company the full cost of repair or replacement directly. The Renter may seek reimbursement from their card provider independently.
  • Theft — no theft security: The Company provides no theft insurance. All scooters are equipped with a handlebar lock and an additional safety lock. Loss of the vehicle due to theft is the full financial responsibility of the Renter up to the vehicle's commercial value.
  • Key loss: If the vehicle keys are lost during the rental period, the Renter is responsible for the full cost of retrieving or replacing the keys. If the keys are located outside of Argostoli, the Renter also bears the cost of transportation to retrieve them and the cost of creating replacement keys.
In all excluded circumstances, the Renter is personally and fully liable for the total cost of repair, replacement, or any related expenses. The Company will pursue recovery of these costs through all legal means available under Greek law, including retention of the security deposit and civil claims.

Section 12

Geographic Restrictions

The use of all rented vehicles is strictly limited to the island of Kefalonia, Greece. Use of any vehicle outside the boundaries of Kefalonia is expressly and absolutely prohibited.

Any use of the vehicle outside the island of Kefalonia automatically voids all insurance coverage, regardless of circumstances. The Renter assumes sole and unlimited financial liability for any damage, loss, accident, or legal consequences arising from use of the vehicle outside Kefalonia.

Scooters must be operated exclusively on public, paved roads open to motor traffic. Use on private land, beaches, footpaths, or any terrain not designated as a public road is prohibited and is not covered by insurance.

Section 13

Fuel Policy

The Company operates a full-to-full fuel policy. The vehicle will be provided with a full tank at collection. The Renter is obligated to return the vehicle with an equally full tank.

Shortfall Charge

Cost of consumed fuel deducted from deposit.

If the vehicle is returned with less fuel, the cost of consumed fuel will be calculated at the current market price per litre and deducted from the security deposit. An additional refuelling service charge may also apply. The Renter must use the correct fuel type as specified by the vehicle manufacturer. Using incorrect fuel constitutes serious misuse of the vehicle and the Renter will be liable for all resulting repair costs. These costs are not covered by insurance.

Section 14

Prohibited Use

The Renter agrees not to use the rented vehicle in any manner listed below. Violation of any prohibition constitutes a material breach of this Agreement and voids all insurance coverage.

  • Under the influence: Operating the vehicle while under the influence of alcohol, drugs, prescription medication that impairs driving ability, or any other intoxicating substance is strictly prohibited and is a criminal offence under Greek law.
  • Passenger limits: Scooters are designed and insured for a maximum of one (1) passenger in addition to the driver. Carrying more than one passenger is prohibited.
  • Off-road use: Driving on unpaved roads, dirt tracks, gravel paths, beaches, agricultural land, or any terrain that is not a designated and surfaced public road is strictly prohibited.
  • Speed limits: Exceeding posted speed limits applicable on Kefalonian roads is prohibited. Reckless or dangerous driving constitutes a breach of this Agreement.
  • Unauthorised drivers: Only the primary Renter and declared additional drivers may operate the vehicle. Allowing an undeclared third party to operate the vehicle is strictly prohibited.
  • Sub-letting: The Renter may not sub-let, loan, hire, or otherwise transfer possession of the vehicle to any third party.
  • Towing: Using the scooter to tow any other vehicle, trailer, or object is prohibited.
  • Racing and stunts: Using the vehicle in any competition, race, endurance event, speed test, or for the performance of stunts is strictly prohibited.
  • Overloading: Carrying loads or passengers that exceed the manufacturer's maximum weight capacity is prohibited.
  • Outside Kefalonia: As stated in Section 12, use of the vehicle outside the island of Kefalonia is expressly prohibited.
  • Illegal activities: Using the vehicle for any purpose prohibited by Greek law is prohibited.
  • Abandonment: Abandoning the vehicle in any location without notifying the Company is prohibited. The Renter remains responsible for the vehicle until it is formally returned.

Section 15

Damage, Loss & Financial Liability

The Renter is financially responsible for all damage to the rented vehicle that occurs during the rental period, up to and including the full commercial value of the vehicle.

Damage Assessment

The Company will assess the cost of repair using its own garage or appointed repair service. The Renter may not arrange their own repairs without written consent from the Company. Unauthorised repairs do not reduce the Renter's liability.

Total Loss

If the vehicle is damaged beyond economic repair or is stolen, the Renter is liable for the full commercial value of the vehicle at the time of the incident, less any recoverable insurance payment.

Immediate Payment Obligation

Damage costs are payable by the Renter directly to the Company immediately upon demand. The Company may deduct these costs from the security deposit. Where costs exceed the deposit, the Renter is liable for the full outstanding amount.

Loss of Keys

If the vehicle keys are lost, the Renter bears the cost of retrieving the keys if lost outside the Argostoli area and the full cost of creating replacement keys. These costs are not covered by insurance.

The Renter's liability is not capped at the deposit amount. The Company reserves the right to initiate civil legal proceedings in Greece to recover outstanding amounts.

Section 16

Roadside Assistance & Breakdowns

The Company provides basic roadside assistance in the event of a mechanical breakdown not caused by misuse, accident, or prohibited use. The Renter must contact the Company immediately upon the vehicle becoming immobile.

Response Area

Island of Kefalonia only.
In the event of a road accident, the cost of transporting the vehicle from the accident scene to the Company's station or repair facility must be paid directly by the Renter. These costs are not covered by insurance.

The Company does not guarantee response times and is not liable for any costs or inconvenience suffered as a result of a vehicle breakdown, including costs of alternative transport, accommodation, or missed connections. In the event of an accident, the Renter must: immediately ensure personal safety; call Greek emergency services (112) if there are injuries; contact the Company as soon as practicable; obtain details of any third parties involved; and file an official accident statement as required by Greek law. Failure to follow these steps may void insurance coverage.

Section 17

Theft Policy

The Company provides no theft security insurance. In the event that a rented vehicle is stolen during the rental period, the Renter is solely and fully liable for the commercial value of the vehicle at the time of theft. All scooters are equipped with a handlebar steering lock and an additional secondary safety lock. The Renter must use both locking mechanisms whenever the vehicle is left unattended. Failure to use the provided security locks constitutes negligence and the Renter will bear full liability for any resulting theft. In the event of theft, the Renter must immediately: report the theft to the local police and obtain an official police report; contact the Company immediately; and provide a copy of the official police report to the Company. The Renter is strongly advised to obtain comprehensive travel insurance that includes cover for rental vehicle theft.

Section 18

Safety Equipment

The Company provides one (1) helmet for the driver and one (1) helmet for a passenger free of charge with every scooter rental. The wearing of a helmet is mandatory under Greek law for all riders and passengers on any motorised two-wheeled vehicle. The Renter accepts full personal responsibility for wearing the provided helmet at all times while operating the scooter and for ensuring that any passenger also wears a helmet. The Company's provision of helmets does not transfer any liability to the Company in the event of injury. Helmets must be returned in the same condition they were received. Damage to, or loss of, a provided helmet will be charged to the Renter at replacement cost. For bicycle rentals, the Company recommends the use of a personal helmet. The Company does not provide helmets for bicycle rentals.

Section 19

Additional Drivers

Any person other than the primary Renter who wishes to operate the rented vehicle must be declared to the Company and registered as an additional driver at the start of the rental period. Additional drivers cannot be added retrospectively. All additional drivers must be present at the Company's station at the time of collection and must satisfy all eligibility requirements including minimum age, valid driving licence, and valid identification. The primary Renter remains jointly and severally liable for all actions, damages, violations, and obligations arising from the use of the vehicle by any additional driver. Any accident or damage caused by an undeclared driver is automatically excluded from insurance coverage and the full cost will be charged to the primary Renter.

Section 20

Traffic Violations & Fines

All traffic fines, administrative penalties, parking charges, and any other financial obligations arising from the Renter's use of the vehicle during the rental period are borne exclusively by the Renter. If the Company receives a fine or penalty notice after the rental period has ended, the Company is entitled to recover the full amount of the fine plus any administrative processing fee from the Renter. By accepting this Agreement, the Renter authorises the Company to provide their personal details to the relevant Greek authorities for the purposes of traffic violation prosecution where required by law. The Renter is responsible for familiarising themselves with local traffic laws, speed limits, and parking regulations applicable on Kefalonia.

Section 21

Mileage Policy

The Company offers unlimited mileage for all vehicle categories. There is no additional charge per kilometre travelled, regardless of the total distance covered during the rental period. The unlimited mileage policy applies exclusively within the permitted geographic area of the island of Kefalonia.

Section 22

Taxes & VAT

All rental prices quoted by the Company are subject to Value Added Tax (VAT) as determined and required by the Greek state. The applicable VAT rate is set by the Greek government and is subject to change. The Company is obligated to apply the correct VAT rate at the time of transaction. A breakdown of net price and VAT will be shown on the rental invoice upon request. The Renter is responsible for any taxes or levies that may apply in their country of residence. The Company makes no representations regarding tax obligations outside Greece.

Section 23

Termination of Rental by the Company

The Company reserves the right to terminate the rental agreement and demand immediate return of the vehicle, without refund, in any of the following circumstances:

  • Breach: The Renter breaches any provision of this Agreement.
  • Impairment: The Renter operates or appears to intend to operate the vehicle under the influence of alcohol or drugs.
  • Outside Kefalonia: The Renter uses or intends to use the vehicle outside the island of Kefalonia.
  • Undeclared driver: The Renter permits an undeclared driver to operate the vehicle.
  • Risk of serious damage: The Renter uses the vehicle in a manner that poses a risk of serious damage to the vehicle, to third parties, or to the Renter themselves.
  • Fraudulent information: The Renter provides false or fraudulent information to the Company.
  • Authority recovery: The Company is directed to recover the vehicle by Greek law enforcement or judicial authorities.

Upon termination, all outstanding amounts owed to the Company become immediately due and payable. The Renter must return the vehicle to the Company's station at their own cost and without delay.

Section 24

Personal Data & Privacy

The Company collects and processes personal data from Renters, including names, identification document details, driving licence information, contact details, and payment information, for the purposes of fulfilling the rental agreement, processing payments, managing security deposits, administering insurance, and complying with Greek legal obligations. Personal data is processed in accordance with applicable Greek and European Union data protection legislation, including the General Data Protection Regulation (GDPR) (Regulation (EU) 2016/679). Data is not sold to third parties. Data may be shared with insurance providers, law enforcement authorities, and regulatory bodies where required by law or contract. The Renter has the right to request access to, correction of, or deletion of their personal data by contacting the Company directly.

Section 25

Governing Law & Jurisdiction

This Agreement is governed by and construed exclusively in accordance with the laws of Greece. Any dispute, claim, or controversy arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Kefalonia, Greece. If any provision of this Agreement is found to be invalid or unenforceable, that provision shall be severed to the minimum extent necessary and the remaining provisions shall continue in full force and effect. This Agreement constitutes the entire agreement between the parties relating to the rental of the vehicle.

These Terms and Conditions were last updated in June 2025. Assos Moto Rent And Go reserves the right to amend these Terms at any time. The current version will always be available on our website.
